Arbitration. ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT, OR THE BREACH, TERMINATION OR INVALIDITY THEREOF, SHALL BE SETTLED BY ARBITRATION IN ACCORDANCE WITH THE ELECTRONIC TRANSACTION ARBITRATION RULES OF THE HONG KONG INTERNATIONAL ARBITRATION CENTRE AS AT PRESENT IN FORCE AND AS MAY BE AMENDED BY THE REST OF THIS CLAUSE. THE APPOINTING AUTHORITY SHALL BE THE HONG KONG INTERNATIONAL ARBITRATION CENTRE. THE PLACE OF ARBITRATION SHALL BE HONG KONG AT THE HONG KONG INTERNATIONAL ARBITRATION CENTRE (HKIAC). THE DISPUTE SHALL BE HEARD BEFORE A PANEL OF THREE (3) ARBITRATORS. YOU AND WE HEREBY EXPRESSLY WAIVE TRIAL BY JURY. DISCOVERY AND RIGHTS TO APPEAL IN ARBITRATION ARE GENERALLY MORE LIMITED THAN IN A LAWSUIT, AND OTHER RIGHTS THAT YOU AND WE WOULD HAVE IN COURT MAY NOT BE AVAILABLE IN ARBITRATION. NEITHER YOU NOR WE WILL PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION FOR ANY CLAIMS COVERED BY THIS AGREEMENT TO ARBITRATE. YOU ARE GIVING UP YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER ON ANY CLASS CLAIM YOU MAY HAVE AGAINST US, INCLUDING ANY RIGHT TO CLASS ARBITRATION OR ANY CONSOLIDATION OF INDIVIDUAL ARBITRATIONS. NOTWITHSTANDING ANY PROVISION OF APPLICABLE LAW, THE ARBITRATOR SHALL NOT HAVE THE AUTHORITY TO AWARD DAMAGES, REMEDIES OR RELIEF THAT CONFLICT WITH THIS AGREEMENT.

YOU AGREE THAT ANY DISPUTE, CONTROVERSY OR CLAIM THAT YOU MAY HAVE ARISING OUT OF OR RELATING TO THE SITE OR THE CONTENT MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER SUCH DISPUTE, CONTROVERSY OR CLAIM ARISES. OTHERWISE, SUCH DISPUTE, CONTROVERSY OR CLAIM SHALL BE PERMANENTLY BARRED.

Choice of Law. This Agreement, and all claims or causes of action (whether in contract, tort or statute) that may be based upon, arise out of or relate to this Agreement, or the negotiation, execution or performance of this Agreement (including any claim or cause of action based upon, arising out of or relating to any representation or warranty made in or in connection with this Agreement or as an inducement to enter into this Agreement), shall be governed by and enforced in accordance with the internal laws of the Hong Kong Special Administrative Region, including its statutes of limitations, without regard to any conflict of laws principles.

17. Miscellaneous

These Terms, together with the Privacy Policy, Cookie Policy, Responsible Gambling Policy and any notices published on the Site, constitute the entire agreement between you and us regarding your use of the Site.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.

We may assign or transfer our rights and obligations under these Terms at any time. You may not assign your rights or obligations without our prior written consent. These Terms are drafted in English. If these Terms are translated into another language, the English version shall prevail in case of conflict.
